Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of KvantumCI, a SaaS platform for DevSecOps posture management ("Service"), provided by HackiHub s.r.o., a company registered in the Czech Republic ("Provider", "we", "us").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

• Customer / User – Any individual or entity accessing or using the Service.
• Account – A user profile registered via the Service.
• Content – Any data, configuration files, CI/CD definitions, metadata, or other materials provided by the Customer.
• Service – The KvantumCI cloud-based DevSecOps posture management solution.
• Intellectual Property – All proprietary rights, including algorithms, rules, scanning logic, configuration descriptors, UI/UX, and workflow mechanisms.

To use the Service, you must:

• Be at least 18 years old.
• Provide accurate and complete registration information.
• Maintain confidentiality of your login credentials.

You are responsible for all actions performed under your account.

Subscription eligibility and team size: For purposes of subscription tiers, "team size" means the total number of individuals within your organization or affiliated entities who have access to, manage, contribute to, or benefit from the repositories, CI/CD systems, or infrastructure analyzed by the Service, regardless of whether each individual holds a KvantumCI account. This includes employees, contractors, and service providers.

Personal tier accounts may use personal email addresses and are limited to individual use. Teams and Enterprise accounts must use a company email address.

Subscription tiers are based on team size, not on the number of active users or seats. If we reasonably determine that your organization exceeds the limits of your current tier, we may require an upgrade, adjust billing accordingly, or suspend access until compliance is restored. We may request reasonable information to verify team size and eligibility.

You agree NOT to:

• Use the Service for illegal activities.
• Attempt to interfere with, overload, or misuse the system.
• Access or use the Service in a manner that circumvents rate limits or technical controls.
• Introduce malware, attempt unauthorized access, or probe the platform.

KvantumCI does not store sensitive project data; it processes metadata and configuration files provided by the Customer for analysis purposes.

We commit to:

• Processing data in accordance with GDPR and applicable EU laws.
• Storing only necessary metadata for analysis and reporting.
• Not sharing customer data with third parties except where legally required.

You agree to:

• Have lawful rights to upload and process the data through the Service.
• Ensure that uploaded data does not contain personal or sensitive information unless legally permitted.

All rights, title, and interest in KvantumCI, including but not limited to:

• Rule engine logic and architecture
• Descriptor schemas
• Detection mechanisms
• Scanning algorithms
• Workflow orchestration
• UI/UX elements
• Design, brand, trademarks
• Documentation and training content
• Infrastructure templates

are the exclusive property of HackiHub s.r.o.

6.1. Strict Prohibition on Copying & Replication

You agree not to:

• Copy, reproduce, or replicate the platform, features, workflows, or mechanisms.
• Develop competing products using insights, logic, or ideas derived from the Service.
• Imitate scanning mechanisms, rule definitions, metadata extraction processes, or the DevSecOps posture engine.
• Clone dashboard layouts, UI/UX navigation, or conceptual structure.

This includes creating derivative works or feature-equivalent systems based on your access to KvantumCI.

6.2. No Reverse Engineering

You agree not to:

• Reverse engineer, decompile, or disassemble the Service.
• Attempt to derive source code, internal logic, or algorithms.
• Interfere with encryption, security, or computational mechanisms.

6.3. Confidentiality

All non-public information accessed through the Service is confidential and may not be disclosed.

Violation of this clause may result in immediate account termination and legal action.

During the term of your subscription, you receive a limited, non-exclusive, non-transferable, revocable license to use the Service.

You may not sublicense, distribute, resell, or make the Service available to third parties.

If you use the KvantumCI API:

• We may enforce rate limits.
• Excessive or abusive usage may result in throttling or suspension.
• You may not use the API to build competing products.

Subscription fees (if applicable):

• Are payable in advance.
• Automatically renew unless cancelled.
• Are non-refundable except where required by Czech law.

You may cancel your subscription at any time, but no refunds are provided for unused periods.

The Service is provided "as is", without warranties of any kind.

We disclaim all implied warranties, including:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Availability or uptime

To the maximum extent permitted by law:

• Our liability is limited to the amount paid by the Customer in the preceding 12 months.
• We are not liable for indirect, special, or consequential damages.
• We are not liable for damages arising from CI/CD misconfiguration, incorrect usage, or third-party integrations.

You agree to indemnify and hold harmless the Provider from claims, damages, or losses arising from:

• Misuse of the Service
• Illegal data uploads
• Violations of these Terms
• Attempts to copy, replicate, reverse-engineer, or reimplement the Service

We may suspend or terminate your account if:

• You violate these Terms
• You misuse the Service
• You attempt to copy or replicate platform logic
• Required by law or security necessity

Upon termination, your access will be disabled and stored data may be deleted.

We may update these Terms from time to time. Continued use of the Service constitutes acceptance.

These Terms are governed by the laws of the Czech Republic.

Any disputes will be resolved exclusively by the courts of the Czech Republic.
